From the EMPTY() function point of view CHR(9) is no different from CHR(10) or CHR(13). They all represent white space. The ISBLANK() function seems to be more approprite to check if field is empty or it has any data stored in it..
I agree with you that EMPTY(NULL) should returnn NULL.
