As mentioned in the scripture, this was a trap, much like what you're trying to do here. :-) The Jews were then living under Roman rule, and they did not give the Jews the right to kill anyone. So, this was a no win situation - either his answer would violate Roman law or Mosaic law.
Later, the Bible indicates that we are to submit to governmental authority (Romans 13).
