From what I gather from reading about his case, he is being held in a military "prison" as a prisoner of war, much like those being held at Guantanamo because of his link to Al Qaeda.

No one seems to argue that he is or met with with Al Qaeda network in Pakistan learning to make "dirty bomb" and other terrorist tactics.

So I guess the question is, is he an Al Qaeda "soldier", which some would say makes him a prisoner of war, or just an average street thug?
