I just completed a large WC insurance carrier application that was under development for the last 1 1/2 years.
The owner and I agreed to split 50/50 on any future sales of the application. They will do the marketing as the owner has many contacts in the industry and is quite a salesman. It appears by the end of the year, we have a good chance to sell it to another carrier in which the owner has an equity interest.
I will be doing all the conversion and customization to the appications we sell.
I own the propietary rights to the source code, so they can't sell it to another developer. While I wrote a lot of the software specifically for and paid by my client, a lot of the routines I had developed years ago and they have paid nothing for those, so I insisted on keeping the propietary rights to the software.
This was all agreed upon up front and everyone understands the issue.
After being stung one other time, I got a little smarter the next time.
