I think most of problems arise from government/laws being in existance at all.

If everybody had to at pay for the cost of "dangerous habits" themselves, there would certainly less risk seen from employers view (still, key people being sick late in beta can worrysome). Also the IMHO idiotic way to enforce "fairness" by having certain groups assigned "equal treatment rights" to be selected for a job makes this a problem. Why is governments perception of fairness/risk involved better than the correcting influence of the market place ?
