The whole idea that the evidence must be obtained in a legal way, from what I've understood about the legal system here (which is mostly from what courtroom is shown in police shows), is that the illegally obtained evidence can't be used in court, period.
Now if the legal system is thrown out the window for a category of cases, then who cares (and who can tell, anyway) whether there is any evidence, and how is that evidence acquired. The fine line of distinction between prisoners and detainees - the detainees aren't even found guilty, they're just held.
