Yes, but it gives the prosecution leverage against the seller if a weapon is used to committ a crime. There are a lot of stupid people in the world, including ones that will admit they intend to do something criminal.
Let me give you an example. My ex-wife once threatened to ventilate a neighbor across the street - more than once, and in front of others. She was just looney enough to do it. I was already contimplating divorce, and decided to move all my firearms out of the house. If I hadn't, then according to state law, I could have been held liable for making the weapons available.
