In Texas we base a lot of our criminal law - and convictions - on intent. I had a long discussion with a police officer regarding this. If I carry a baseball bat in my truck, what is my intent? It might be left there after a game, but (more likely) I intend to use it as a weapon in case of (fill in the blank).
But even then, unless I approach someone with the INTENT of using it against them, the bat is still not a weapon.
Guns are no different. The primary function of a firearm is to accurately deliver a projectile to a target.
That's it. My intent makes it either a tool for hunting, poking holes in paper, blowing up water-filled soda bottles, or injuring another human being. The gun's ability to successfully accomplish what I
intend it to do does not define the primary function of all firearms.
