In cases in which the administration undertook domestic surveillance without first obtaining a warrant, the administration "did not seek" a warrant from the FISA court within 72 hours, as the statute requires, or ever. U.S. citizens inside the continental U.S. (domestic) were indeed part of the wiretapping.
