>I take it from my personal experience (I am a current H1B holder), long talks about different cases with my lawyer and from colleagues in my same situation, and I mean H1B Computer Science positions.

>FYI, my employer salary offer, according to the job description he provided to the Maryland Department of Labor (DoL), was $12000 (yearly) below the amount required to hire H1B's holders. The spirit of the legislation is that, under generally accepted competitive job market laws, H1B visas shouldn't be used as an excuse to pay lower salaries.

>It could also be the case that the employer is not honoring the salary requirements that he was indicated by the DoL to pay or that the employer provided the Dol with a job description different from reality to get a lower quote on the Prevailing Wage, I think that those cases you mentioned wouldn't pass an auditing process from the authorities, which is the only way to prove it.

>In all cases, assuming that you don't feel comfortable with employers hiring foreigners and/or paying lower salaries, shouldn't the employers be blamed for this practice, instead of the people they hire? I am not saying that you in some way implied this, I am just thinking that following this line of thought, we may be killing the messenger, deviating the focus of attention: The need for hiring foreigners comes from employers, no one else, and they may have good reasons for this and if they don't, then they should be exposed.

I agree with you that employers who pay less just because they can is not the right way, but it is the American way".

A person needs a job. He is not going to refuse $100,000. But he may need it badly enough that he'll take $15,000. if it is offered.
This isn't the fault, in any way, of the person needing the job, but rather the fault of the prospective employer.

It's the American way to pay as little as you can, whether it is for goods and services or as wages.

Wal-Mart takes it to the extreme, but they do it because moving jobs to China generates more and more customers for Wal-Mart. People that used to buy elsewhere, now on unemployment or dole, have no choice but to go to Wal-Mart for their needs now.
