WalMart has bastardized and shamefully exploited the original intent of eminant domain (which was for public utilities, power line corridors, highways, etc).
You can't claim that they represent the concept of 'free market' when they go crying to local politicians that they want to build in a city, but can't find a location. [and the local politicians are just as bad]
These days, WalMart/politicians have tried to use E.D. to boot people/businesses off their property even for such simple reasons as WalMart will bring in more property taxes. Their justifications are often way too flimsy.
A free or even substantially free market begins with the concept of individual rights and property rights, and the protection thereof.
I think WalMart's model represents fascism a little more than capitalism. It's downright sad and SHOULD be unconstitutional. Unfortunately, few politicians have the balls to actually represent the people.
