I think there are a few who are sort of grandfathered in at this point because they have been MVPs for so long, and Dan is in that category. That doesn't bother me a bit because I know Dan was EXTREMELY generous with his time and his expertise long before there was an MVP program. Not only online but in user groups. He may not be online much these days but (honestly) he is one of the first people I think of when I picture what an MVP should be.
