And as the law says, they are both misdemeanors, and there's the policy of doling out different punishments for different crimes - that's what legal system does. No problem there.

IOW, we were discussing the mere existence - illegal sojourn under two sets of laws, yes or no. The "how much" is then the matter for the court to decide, once the existence is established and if it ever gets to court.
