Again, why? The same set of laws apply to them: the laws of the USA. They are both committing no more than a misdemeanor. Neither infraction is causing any bodily harm to anyone, nor any immediate material damage. They are both in the "we don't want you in this place" category. So anyone entering the park with the intent of sleeping there in an area where the vagrancy laws are on the books, is basically entering with intent to stay where they shouldn't.
So what are you saying, one of them is less human just because they're homeless, or what? I don't get it, and Jay just gave up trying to explain. Seems to be we hit a blind spot every time we got to that point, so I never got a proper explanation. What's so funny?
