I was referring to possible legal jeopardy for admin officials who had authorized the use of waterboarding. Thats why Mukasay cant answer the "is it torture?" question because it would put people "in personal legal jeopardy". Granted we've passed legislation that retroactively protects those involved, but Intl law doesnt care about that.
