I cannot tell you how much your statement bothers me. This is the equivalent to someone shooting inside your house and killing someone. You call the police and there are two people outside who may have done it. The police take both into custody and they are both placed in jail. They do not receive a trial or a lawyer but instead are interrogated everyday. While sitting in prison they are shot. They may or may not be guilty.

I have thought about this much over the past few years. If those in Guantanamo are considered POWs then they can be held until hostilities cease and treated according to the Geneva Conventions. That does not give us the right to torture them in the duration. The term 'detainee' falls into no-mans-land. They should not be tortured regardless. Anyone 'detained' should be treated according to the Geneva Conventions, even those states who are not a party to the convention. Their status needs to be resolved and should not be left as 'detainee.' Either declare them prisoners of war or get them lawyers and the right to prove their innocense in a court of law.
