The old fashioned way, we voted on it, and like most direct votes of the people (Propositions) the courts have overruled the will of the people.

To be frank, I don't have a dog in this fight. I don't care either way about the issue. My concern, as you may guess, is with the unelected judges overturning the will of the people.

As an interesting aside, this has re-energized the effort to get a same-sex marriage ban in the State Constitution. If the proposition makes it to the ballot then Obama's victory in the state will be closer. He may only win by 10% instead of 15-20%. ;)
