Then compile it in VFP 9 (it breaks). I wrote Hsia about this issue - but no response. I did not learn about it until I tried to move a VFP IIS COM from 8 to 9. It seems that VFP 9 does not like COM's (DLLs) that issue a CREATEOBJECT .
It's documented change in the behavior in VFP9: "The ability to have a property assignment set to instantiated object is no longer supported in a class definition and will generate an error".
