As I pointed out in other messages, it depends on where they are and who is prosecuting them. Outside the US, the military deals with them and they are deemed terrorists, or whatever. Here in the states, law enforcement deals with it and there is a long series of court cases that give some rights to people on our soil, but not full rights of citizenship. The liberal judges on the supreme court have done a lot of damage to that, but there are still some rights they don't have.
