replying to myself in case anyone else has this problem. i did try the ACTIVATE MENU _msysmenu NOWAIT like many people suggested. this did not solve my refresh problem.

found a dirty work around that did correct my problem. hope that this is not the ultimate solution. still looking. i editted the .mpr and made cmenuname a public. instead of ACTIVATE MENU _msyumenu NOWAIT used ACTIVATE MENU cmenuname NOWAIT. this worked in my case. when i find the real fix i will report it here.
