The idea that once out of the military, an ex soldier is untouchable, regardless of his crimes, is a horrible idea. Something like 40 soldiers who participated at Mai Lai walked away without a problem simply because they left the military (may they never be able to sleep). And the only one ever convicted was jailed for just over 4 months. That sort of stuff is unacceptable.
Having said that, I do hope that the civilian court is able to make the distinction between a truly criminal act like Mai Lai and a soldier's ordinary job. Bad stuff happens in war, and innocent people die, but indiscriminant murder should always be unacceptable, and if Nuremberg is anything to go by, "I was only following orders" doesn't cut it.
