I'm not up on the details, but I'm fairly certain it's the sale date that matters, of course it probably varies by investment type. I know that the 2003 law extended the cuts for some through 2010 even making 2008-2010 capital gains and dividend tax free for those in the bottom 2 tax brackets. It's all quite convoluted but you can look to Forbes and WSJ for analysis.
