Whether you can win or not in court really doesn't matter if you can't finance the lawyers to stay in court. M$ would be able to keep this in the courts for a long time. Even if you won in lower courts, M$ would appeal to higher courts -- thus keeping the case going. This requires lots of money for staying power. And I don't believe the DOJ would come to the rescue. Anyone that thinks so -- I have some great real estate east of Kennedy Space Center where you can watch the space launches from....
