Claiming executive privilege was my first reaction as well.

I read the other day that Bush is very resistant to issuing a wave of pardons on his way out of office, a la Bill Clinton. There is speculation that Scooter Libby will be pardoned (his sentence was already commuted and he was let out of prison) but Bush is reportedly so against the idea of pardons that his aides know it isn't a good idea to even bring it up. Good for him.
