I'm not sure how you can say that these allegations against him are true. It appears to be unnamed sources, hints, and innuendos.

The bottom line is that when it came time for legal action, whether the Supreme Court of Bosnia, a federal court in the U.S., or a military tribunal at Gitmo, no one could prove anything. In the case of the U.S., we didn't have enough to even try him, but less get a conviction.

If we can't even get him to trial, how strong can our case be?

>I did some more reading on Boumediene. The most consistent information I've seen leads me to believe he (Boumediene) is NOT completely innocent.

> There were reports that he and others were going to attack American troops in Afghanistan - that was apparently the strongest justification for detaining him, but whatever evidence existed (it was either from a single source, or a source viewed as not credible) was viewed as insufficient for Judge Leon.

>About the only thing I'll say is that unlike others, Boumediene probably didn't pose much of a threat on U.S. soil (quite likely because he wanted to get as far away from the U.S. as possible). It's tempting to say this guy was really small potatoes, but innocent? No way. And it's possible we got some information out of him.

>Given what we're up against, I don't see anything here that shatters the concept of Gitmo.

>Additionally, (and this is old news), the Pentagon has reported that some of the detainees who were released last year, have returned to the battlefield against the US and our allies. The actual number of individuals has been debated, as low as 30 and as high as 70 - but there's no disputing that we've released people back to the battlefield who might still wind up killing our own. I find that FAR more alarming....
