It is still possible for a government to outlaw openly offensive behavior. For example, if talking about clothes, nudity is generally disallowed. Burka is openly offensive to good part of humanity and not every religious practice can be tolerated unfortunately. In other words, every area of human discourse/behavior has natural bounds with some parts inevitably going outside of bounds, i.e. becoming unacceptable.
