It has become the practice here to create positions above elected positions when the governor is not happy with the results of an election. If you don't like who the people voted for, he/she would just create a new position overseeing the elected official essentially making the elected position powerless. That is contrary to the state constitution and it finally got knocked down in court:

Now, if only someone would do the same for the czars created by the current president... Building a parallel government, one that's in the constitution and then one that is outside of the constitution and the authority of congress should not be allowed. It bypasses the entire process and removes transparency and oversight completely. If the post wasn't created by congress, then it needs at least to have congressional approval and oversight. No post should be outside the system of checks and balances.
