I'm not sure what you mean by a pre-contract. Be careful with generic contracts. They may not be enforcable where you live. This problem can even exist from state to state in the US. I recommend that you hire a good contract lawyer to write it up, then have it approved by a lawyer that specialized in computer law. You may or may not have specific rights to the source code in your country. For example, in the US, the company the author works for....not the client....owns all copyrights, marketing rights, and patent rights. These can be assigned to another party. This could differ where you live.
