the point in filing the suit is almost never to get your rights rectified. It's the help protect the next person.
You have 180 days from the time of the alleged incident to file with the Equal Employment Opportunity Commission:

Even if he can do that on paper, the process would make him think twice before he did that again. On the other hand, if he was being entirely fair in his evaluation, the only thing he would have had to do is fill out a piece of paper, and believe me, when you run a business, one more piece of paper is like throwing a glass of water into the lake: you won't see it rise in level. <s>
