It's my understanding that you're supposed to have a prescription - but I'm not 100% positive if that is the case in Colorado (but I'm 99.9% sure). What they decided, in this case, is that medical marijuana is considered personal property that can be taxed and shouldn't be treated like prescription drugs, which are tax exempt....so it seems like a double-standard if you ask me - ... but hey its better than outlawing it. Next question I would ask is if these dispensaries are for-profit or are supposed to be non-profit, and what are the tax implications of that.
