I heard the same thing, but I'm not sure that is true. One question is - did the accident occur on private property? If it was on public property, and witnesses can put him in the car, the police could charge him with failure to maintain proper control. It sounds like he has already admitted he is at fault, so they should just write him a summons and be done with it.
