Then give him back the $400 and move on. Having him sign something probably won't keep him from using it if he's dishonest, but you can at least use that as a bit of leverage if you ever need to.
That and the fact that I own the code as it's a work for hire.
Thing is, he's already told me that it's useless to him without the Google functionality. So even though I will notify him that he may not use the product, it's pointless.
