In a representative republic, the people or congress is supposed to make the laws. Judges are supposed to interpret the law as constitutional.

I disagree entirely. People should have the right to vote away other people's rights just because they make them queasy, and most especially when those other's rights have no real impact on their own rights or lives.
If the Judiciary doesn't watch that the majority doesn't trample the rights of the minority, then who will?
