I will bet you a Corona that either they will not hear the case or even if they do, they will uphold the court's ruling without litigation. There is a serious problem here with our system -- and not easy fix. First it has to be open to the public in order to be "justice" that is visible. Second, we have to protect state secrets that risk american lives. We cannot have a closed court because of #1 and because of that, the folks in this suit may really not get their justice which is part of what this country is all about. It may very well be a case of they deserve justice but cannot get it due to #2.

"We have thoroughly and critically reviewed the government's public and classified declarations and are convinced that at least some of the matters it seeks to protect from disclosure in this litigation are valid state secrets," Judge Raymond Fisher wrote for the majority. "The government's classified disclosures to the court are persuasive that compelled or inadvertent disclosure of such information in the course of litigation would seriously harm legitimate national security interests."

I'm thinking a closed court and sealed documents and litigation might be the only way. I don't know what the outcome would be if there were no state secrets involved. It could very well be they would lose regardless. They could win though if they have sufficient evidence and laws and/or rights were broken. Without a court date, we will never know.
