Sure if it is your tenant. A room-mate is another matter. I would certainly not want to share an apartment with a smoker and if I were an Orthodox Jew who kept kosher it would matter to me that I find a room-mate with the same dietary habits. This seems to be a misinterpretation of the intention and the practicality of the law and I am reasonably sure it will never result in any sanction against the woman who posted the ad.
