Someone who gets arrested could also be carrying a laptop or netbook... where does it end? An important argument for encrypting any such devices.

Of course, for the average Joe it's many times more likely they'll lose a smartphone or have it stolen. There are NO restrictions on what the person who finds it, or a thief, might do with it - making encryption and/or remote wipe even more important.

Probably the only way to defeat that kind of nonsense would be to have nothing persistently stored on the device i.e. thin-client. Agents or police could still ask or demand that you cough up passwords but AFAIK that still requires a warrant in most jurisdictions.
