But if you "forced" the new member to read them at sign up, and agree to them from the get-go, at least you would be satisfied that at least you presented it to them. Although in the current predicement I would suggest that the member(s) involved were well aware of the T&C.

When creating an account, the checkbox is not checked. The member has to check it, which indicates that he or she has read the Terms & Conditions.

Yes, members here, at least for regulars, for most of them, are well aware of them and a proper conduct to use on this site. But, as is the case on most sites, many just create the account and never read them.
