Considering that this 'fashion' came into being to announce you'd 'done time' and (I'm guessing) the judge has probably made it well known that he doesn't consider it a fashion for his courtroom and may have asked said man if he was aware of the dress code. If this is the case (and please note the use of the word 'if'), then no - a 3 day contempt of court jail stay is actually kinda light.
