Illegal immigrant having legal status that allows him to be in USA. It is a law. You may find this law inconsistent, not fair or wrong, but according to the law he is not a criminal. Otherwise it would be easy for law enforcement agents to grab him and at least isolate him from us, "legal immigrants".
