Any such person should be free to argue about any impairment they think they've suffered, with as big a gun or lawyer as they can muster :)

Seriously, it's sometimes easy to word definitions in a way that seems elegant but can be maddening in practice. Sort of like how Mandelbrot and Julia sets are defined.

The US Constitution is considered elegant by many, but entire industries have arisen over its interpretation.
