I meant the EULA changing with each new release of the software. Although Rick & Craig definately have a point with the occasions that EULA changes and you are either asked to click again or notified by mail and are considered to have consented if you continue to use the product.

@Craig: not only is there a difference with shrink wrapped and online: as those EULA clauses fall into the area of commonly used rules, they are also checked not to be in violation of "typical" rules - dunno if that is as prevalent in the US as over here, but clauses slipped into such a contract are sometimes voided by german courts, as was the case of MS trying to forbid by legal means moving the bought software.
So even if you accepted the EULA, those portions in violation of "typical rules" as defined by german law were still not enforcable by MS. Also some court rulings exist where the EULA totally was diregarded, as the terms were not agreed upon at the time of sale - usually the way around this is today that terms more uncommon are offered before online sale is made.
