>>>I suggest this article and if there are real constitutional arguments against the point Sowell makes I'm interested.

>The justification in this case is that the people are opposed to Obamacare so Republicans have a duty to fight it. However, the latest survey of registered voters found that only 33 percent believe that Obamacare should be delayed, starved or repealed. 29% felt that Congress should make changes to improve it, 26% said Congress should let the law take effect so people can see how it goes, and 12 percent believe that the law should be expanded. So: voters may be worried that Obamacare won't deliver as promised. But they also believe that it needs to be given a chance to succeed. IOW it's not possible to disguise the attempt to derail it as responding to what the people want. This is a political manoever to prevent the ACA being given a chance to prove itself.

>I'd also observe that if current behavior in Congress is the intent of the system as Sowell asserts, then it's a recipe for chaos. Passing a law means nothing: as soon as "the other side" gains ascendency or the ability to stifle a vote, it can eradicate laws by starving them out

I think Sowell is on pretty firm grounds that the separation of powers is indeed the way the system was intending to work and you correct that sometimes that means things don't happen that some people want very much to happen. Not everyone believes it is a good thing if large scale social engineering can be accomplished with no obstacles, even when they believe there is some social engineering that desparately needs to be done.

As I said, I do not pretend the expertise that everyone else here obviously has regarding the merits of Obamacare. But I know the political theater we are witnessing is just that. Obamacare was pushed into law with similar tactics. It is a shame that the solution to our genuine health care problems could not be addressed in some other way.

I am also sad that tort reform has just been forgotten.

Charles Hankey

Though a good deal is too strange to be believed, nothing is too strange to have happened.
- Thomas Hardy

Half the harm that is done in this world is due to people who want to feel important. They don't mean to do harm-- but the harm does not interest them. Or they do not see it, or they justify it because they are absorbed in the endless struggle to think well of themselves.

-- T. S. Eliot
Democracy is two wolves and a sheep voting on what to have for lunch.
Liberty is a well-armed sheep contesting the vote.
- Ben Franklin

Pardon him, Theodotus. He is a barbarian, and thinks that the customs of his tribe and island are the laws of nature.
