This opposition Congress has been historically reluctant to confirm nominees, which I take as part of their general opposition to Obama getting out of bed in the morning. There are dozens of unfilled judicial positions, some at pretty high levels, because Congress refuses to hold confirmation hearings. That's not me being partisan, that's a fact.
