My rule of thumb in situations like that is "right of weight" :-/ The cyclist would lose, either way :(
That reminded me of an urban legend I heard a while back. Somewhere in Eastern Europe (Bucharest?) there was a gang initiation that went like this:
- there is a large, busy traffic circle/plaza in the middle of the city
- various feeder roads lead radially into/out of the circle
- wait until the middle of the night
- candidate is given a fast car, on a feeder road some distance from the circle
- candidate floors it towards the circle. Must be doing minimum 200 km/h when entering the circle
- blast across the circle and exit onto another feeder road on the other side
