Actually, the mess began with Bush V. Gore when these people (on both sides) made it clear that this court is highly politicized.
I rarely agree with Allan Dershowitz but I agree with this:
"The decision in the Florida election case may be ranked as the single most corrupt decision in Supreme Court history, because it is the only one that I know of where the majority justices decided as they did because of the personal identity and political affiliation of the litigants. This was cheating, and a violation of the judicial oath."

Dershowitz doesn't say it, but the corruption was on both sides.

Since that time with a few exceptions, the decisions of the members of this group (I don't call them judges) have been almost 100% party line.

With an upcoming presidential election, the dems couldn't have crafted a better script.
If they overturn, and I agree with your odds, then the dems will have an awesome issue.

If they don't then at least in part they'll affirm Obama's legacy.
Anyone who does not go overboard- deserves to.
