That depends on the facts of the case, and I'm not familiar with them.

If I were responsible for ferreting out espionage agents and I thought a reporter was participating, I'd certainly be OK with that.
In that case, the "event", in my mind would be the espionage, not the subpoena, and certainly not what someone said about the subpoena.

In any case, the video clip you gave me didn't discuss what you call the event. It discussed what Eric Holder thought about previous comments he had made about what you call the event.
I don't consider that news.
