I think a user will be process about MS and will win. I think this's illegal. Maybe not in USA but I'm sure it's illegal at some countries. MS was claiming OEM licenses cannot be issue about used software selling but recently turkish courts decided softwares can be sell to third party in any manner, included OEM's.
