Doesn't really matter what you or I think re his right or responsibility. What matters is that you insist on seeing a tasteless smirk because of Scalia's death rather than a wry smile because he's going to nominate whether the detractors like it or not. It's not as if he was the one who joked about glassing (nuking) Arab desert nations.
