Surely this is not discrimination against Trans folk- it's concern that abusive types now can make outlandish claims to justify unsafe practices, under the guise of inclusiveness. Seems to me that even a blunt instrument like HB2 won't prevent genuine Trans people continuing to do their thing without complaint, but it does prevent abusers taking advantage of society's desire to be inclusive. Unfortunately the 5 examples above confirm that this is not made up: we must not underestimate human (mostly male) ability to come up with ways to twist laws to hurt others, especially kids.

So the question then becomes whether such a spur of the moment claim is a valid defense. My guess is that it isn't. And the reality is that there have been cases of men invading women's bathrooms in various ways since long before there was discussion of trans folks in this context.
