I actually was looking for one of those when I bought my Elise -- but the twin-cam versions of the Europa's cost almost as much as an Elise these days.

IMO first line of battle will be between driver and manufacturer - on the lines of whether advertising of manufacturer caused driver to be less attentive than situation warranted.
Software has to be modified and tested in each car, so only thing manufacturer can hope for is finding a gloal fault i the software, trying to reclaim some losses.
Might be interesting if Tesla as a company with relatively small turnover and high percentage of self-driving claims could be squeezed into a take-over scenario
